This Privacy Policy describes how Perpetual Quest, LLC ("NamingForce," "we," "us," or "our") collects, uses, discloses, and protects personal information when you visit namingforce.com (the "Website") or use any related products, features, or services (collectively, the "Services"). This Policy applies to individuals in the United States. We do not offer social login options and we do not address jurisdictions outside the U.S. in this Policy.

By accessing or using the Services, you agree to our collection, use, and disclosure of information as described here. Your use of the Services is also subject to our Terms of Service.

1. Scope

This Policy covers information we collect about users and visitors of our public Website, Buyers and Creatives who create accounts, Sellers who list domains, and prospective business contacts who interact with us in the U.S. It does not cover information processed by third parties that we do not control. Our Services are intended for use in the United States only.

2. Information We Collect

2.1 Information You Provide

  • Account & Profile: name, display name, email address, password, billing and mailing address, phone number, and any optional profile details. We do not support or use social logins.
  • Transactions: purchase details, payouts and tax forms (e.g., W-9/W-8BEN data you upload), payout account details (e.g., PayPal or Payoneer identifiers), and support communications related to payments.
  • Contest & Marketplace Content: contest briefs, creative submissions, comments, votes, ratings, and marketplace listings (including domain names and metadata).
  • Communications: messages you send to us (email, chat, forms), survey responses, and feedback.
  • Support & Verification: identity documents or other information you choose to provide for account verification, fraud prevention, or compliance purposes.

2.2 Information Collected Automatically

  • Usage & Device Data: IP address, device identifiers, browser type, operating system, pages viewed, links clicked, time spent, and referring/exit pages.
  • Cookies & Similar Technologies: we use first- and third-party cookies, pixels, and local storage for essential functions, analytics, performance, personalization, and advertising/retargeting. See Section 7 for choices.

2.3 Information from Third Parties

  • Payment & Payout Processors: limited details to confirm transactions (we do not store full payment card numbers).
  • Service Providers & Partners: analytics, anti-fraud, security, and customer support providers may supply information about Service performance and risk signals.
  • Publicly Available Sources: domain WHOIS and other records tied to marketplace listings.

We may aggregate or de-identify information so it can no longer reasonably be linked to you. We may use and disclose such information for any purpose.

3. How We Use Information

  • Provide, operate, and improve the Services, including contests, marketplace functionality, and user support.
  • Process transactions, payouts, and tax documentation; detect and prevent fraud and abuse.
  • Personalize experiences and content (e.g., saving preferences, ranking content, and recommended listings).
  • Perform analytics, debugging, and Service monitoring.
  • Send transactional communications and respond to your requests; send marketing communications where permitted (you may opt out).
  • Enforce our Terms of Service and other policies; protect our rights, users, and the integrity of the Services.
  • Comply with applicable U.S. laws and respond to lawful requests.

4. How We Disclose Information

  • Service Providers: vendors who assist with hosting, security, analytics, support, communications, payments, and advertising. They may only use information to provide services to us and must protect it.
  • Other Users: information you choose to include in public areas (e.g., contest entries, marketplace listings, public profiles) is visible to others.
  • Legal, Safety, and Security: to comply with law, legal process, or governmental requests; to enforce our terms; or to protect the rights, property, or safety of NamingForce, our users, or the public.
  • Business Transfers: in connection with a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction.
  • With Your Consent: we may disclose information in other ways with your direction or consent.

We do not sell your personal information for money. We may disclose certain information for targeted advertising or “sharing” as described in Section 7 and 9, and you may opt out.

5. Payments & Payouts

We use third-party payment and payout processors. We do not store full payment card numbers. Processors handle your payment information in accordance with their own privacy policies. Payout providers (e.g., PayPal, Payoneer) process your withdrawals.

6. Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this Policy, including to provide the Services, comply with our legal obligations, resolve disputes, enforce agreements, and maintain business records. Retention periods vary based on account activity, contest participation, marketplace transactions, and legal requirements. We may retain aggregated or de-identified data without time limits.

7. Cookies, Targeted Advertising & Analytics

We and our partners use cookies, pixels, and similar technologies to operate the Services, remember preferences, measure performance, understand usage, and deliver ads relevant to your interests. You can manage cookies through your browser settings and, where available, our cookie controls.

7.1 Your Choices

  • Browser Controls: most browsers allow you to block or delete cookies. Doing so may impact site functionality.
  • Advertising Opt-Outs: visit DAA, NAI, or AppChoices for interest-based advertising choices on your browser or device.
  • Email Marketing: use the unsubscribe link in our emails to opt out of marketing communications. We may still send transactional or service-related messages.

Do Not Track: we currently do not respond to browser “Do Not Track” signals because no industry standard has been adopted.

8. Security

We implement reasonable administrative, technical, and physical safeguards designed to protect personal information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

9. U.S. State Privacy Rights

Depending on where you live in the United States, you may have rights regarding your personal information, such as the right to request access (know), correction, deletion, portability, and the right to opt out of certain processing (e.g., targeted advertising, sale, or profiling). California residents also have the right to limit certain uses of sensitive personal information and to be free from discrimination for exercising their rights.

9.1 How to Exercise Your Rights

  • Submit a request at /privacy/requests or email [email protected].
  • We will verify your identity by matching information you provide with information in our records. If we cannot verify you, we may ask for additional information or deny the request.
  • You may authorize an agent to submit a request on your behalf. We may require proof of authorization and verification of your identity.
  • To opt out of targeted advertising or “sharing,” use our Do Not Sell or Share link and adjust cookie settings (see Section 7).
  • If we deny your request, certain states allow you to appeal. To appeal, reply to our decision email or write to [email protected] with “Privacy Appeal” in the subject.

9.2 Notice at Collection (California)

This chart summarizes the categories of personal information we may collect, the purposes, and typical retention considerations.

  • Identifiers (e.g., name, email, IP address): used to provide the Services, secure accounts, and communicate; retained for the life of the account plus a reasonable period.
  • Customer Records (e.g., billing address, transaction history): used for transactions, compliance, fraud prevention; retained per tax, accounting, and legal requirements.
  • Commercial Information (e.g., purchases, domain listings): used to operate contests and marketplace; retained per business and legal needs.
  • Internet/Network Activity (e.g., device and usage data): used for security, analytics, and performance; retained for shorter operational periods unless needed for security or legal reasons.
  • Geolocation (coarse): derived from IP for fraud and localization; retained per security needs.
  • Professional/Employment data (optional in profiles): used for community context; retained while provided.
  • Inferences (e.g., preferences): used to personalize content; retained while relevant.
  • Sensitive PI: we do not collect Social Security numbers or precise geolocation. We may process government IDs or tax numbers only when you provide them for compliance or payouts.

10. Children’s Privacy

The Services are not directed to children under 16, and we do not knowingly collect personal information from children under 16. If you believe a child has provided us personal information, contact us and we will take appropriate steps to delete it.

11. User Content & Public Areas

Content you post publicly (e.g., contest entries, comments, marketplace listings) may be visible to other users and indexed by search engines. Think carefully before sharing personal information in public areas of the Services.

12. Third-Party Sites & Services

The Services may contain links to third-party websites, services, or applications. We are not responsible for their content or privacy practices. Review their privacy policies before providing information to them.

13. Changes to This Policy

We may modify this Policy from time to time. The “Last Updated” date indicates when it was last revised. Material changes will be posted on the Website. Your continued use of the Services after the effective date of a change signifies your acceptance of the updated Policy.
